Online Bookstores & Consent: We Tested 5 Sites for Pre-Consent Tracking
Sending visitor data to third parties before consent is the footprint behind CIPA “wiretapping” and VPPA lawsuits in the U.S., and GDPR / ePrivacy enforcement in the EU. We ran an automated pre-consent tracking scan on 5 online bookstores to see how the group measures up.
How many online bookstores track visitors before consent?
60% loaded at least one third-party tracker before any consent was given. Of 5 sites scanned: 2 were clean (grade A), 0 graded C, 1 graded D, and 2 graded F. Sites averaged 2.4 pre-consent third-party trackers each.
The most common pre-consent trackers
| Tracker | Type | Share of sites |
|---|---|---|
| Google Tag Manager | analytics | 60% |
| Google Analytics 4 | analytics | 60% |
| Google Ads / DoubleClick | pixel | 40% |
| Meta Pixel | pixel | 40% |
| TikTok Pixel | pixel | 20% |
| Microsoft Clarity | replay | 20% |
VPPA and ineffective-banner exposure
0% of the sites paired a video player with a pre-consent marketing pixel — the VPPA footprint plaintiffs target. 20% showed a consent banner that was present but not actually blocking the trackers.

Methodology
We loaded each site once with no prior consent and recorded which third-party trackers fired before any consent action, using the ForensicConsent detection ruleset. This reflects a single page’s public behavior on one cold load, not a legal verdict. See our methodology.
