Lighting Stores Online & Consent: We Tested 8 Sites for Pre-Consent Tracking

Sending visitor data to third parties before consent is the footprint behind CIPA “wiretapping” and VPPA lawsuits in the U.S., and GDPR / ePrivacy enforcement in the EU. We ran an automated pre-consent tracking scan on 8 lighting stores online to see how the group measures up.

25% loaded at least one third-party tracker before any consent was given. Of 8 sites scanned: 6 were clean (grade A), 0 graded C, 0 graded D, and 2 graded F. Sites averaged 1.4 pre-consent third-party trackers each.

VPPA and ineffective-banner exposure

0% of the sites paired a video player with a pre-consent marketing pixel — the VPPA footprint plaintiffs target. 13% showed a consent banner that was present but not actually blocking the trackers.

Methodology

We loaded each site once with no prior consent and recorded which third-party trackers fired before any consent action, using the ForensicConsent detection ruleset. This reflects a single page’s public behavior on one cold load, not a legal verdict. See our methodology.
